These General Terms and Conditions of Sale apply to all orders placed on the website france-export-fv-online.com and to orders placed by particular natural persons by telephone. Article II - Prix
The prices of our products are indicated on the site in euros including VAT, excluding participation in the processing and shipping costs of the grocery store France-Export-FV. When ordering, the products will be invoiced on the basis of the rates in force at the time of validation of the order. The products remain the property of the grocery store France-Export-FV until full payment of the price.
Special cases of orders sent outside the European Union:
In case of order to a country other than metropolitan France you are the importer of the product(s) concerned. For all products shipped outside the European Union and DOM-TOM, the price will be automatically calculated excluding taxes on the invoice. Customs duties or other local taxes, import duties or state taxes may be payable. These duties and sums are not the responsibility of the grocery store France-Export-FV. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to inquire about these aspects with your local authorities. It is also your responsibility to inquire with the local authorities about any import limitations of the products you plan to order.
Exceptional cases of orders sent to the European Union:
The price is calculated including VAT. For professionals with an intra-community VAT number who would like to be exempt from VAT, they must first contact the grocery store France-Export-FV by email or phone. The procedure to be followed will be specified. Orders that will be placed directly on the site without prior contact will not be able to benefit from the VAT exemption even if the customer provides an intra-community VAT number.

You can choose between 2 delivery methods:

Processing and shipping costs are calculated based on the weight of your order and the country of destination. You can choose between 3 formulas: Colissimo International or Colissimo DOM TOM or Chronopost. You can find out the amount of the processing and shipping costs at any time by consulting your shopping cart.
Also note that your order is invoiced to you excluding taxes. Depending on the country, customs taxes may be required in addition to delivery.

Article V – Validation of an order
Validation by the customer:
You declare that you have read and accepted these General Terms and Conditions of Sale before placing your order. The validation of your order therefore implies acceptance of these General Terms and Conditions of Sale. For orders placed directly on our website or by phone, if you have left us an email address, you will receive an email confirming your order.
Unless proven otherwise, the data recorded by the France-Export-FV-Online.com grocery store constitutes proof of all transactions between the France-Export-FV-Online grocery store and its customers.
Validation by France-Export-FV-Online.com
Upon receipt of orders, the France-Export-FV-Online grocery store ensures the consistency of the data communicated. As part of its policy to fight against fraudulent payments, the grocery store France-Export-FV-Online reserves the right to conduct any necessary investigation before the validation of an order. This may include requesting proof of address or requesting the details of your bank branch. When such a procedure is initiated, the validation of the order is suspended. Article VI – Availability
Our product offers are valid as long as they are visible on the site, within the limits of available stocks. In the event of product unavailability after placing your order (stock error, breakage of a product), we will inform you by email or phone. We will then offer you the choice:
Reimbursement of the missing product(s) by Automatic recredit or Cheque
OR

Article VII – Delivery
The products are delivered to the delivery address you indicated during the ordering process. For deliveries in France, deliveries are made by La Poste, chronopost or adapted carrier.
In case of payment by credit card, orders are shipped the day after their online validation. Orders validated on Friday are shipped the following Monday except exceptional opening on Saturday in December. Orders validated on Saturday are shipped on Monday and orders validated on Sunday are shipped on Tuesday.
Article VIII – Delivery times
The delivery times indicated here are valid under normal conditions of service and for shipments made by our usual carriers.
If the processing of your order (in particular because of the weight of the packages...) required a special routing solution, the delivery times would be specified to you during your order. If these deadlines should not satisfy you, you will have the possibility to cancel your order.
Similarly, in the event of a strike by la Poste services, road hauliers (more generally any social disruption), or climatic or diplomatic incidents, delivery times could be extended.
France:
For colissimo tracked shipments, you will receive your package within 48 – 72 working hours following the date of shipment for any order placed before 11am from Monday to Saturday.
For Chronopost shipments, you benefit from an express delivery service with the guarantee of receiving your packages the next day for any order placed before 11am from Monday to Thursday. Chronopost departures are provided on Monday, Tuesday, Wednesday and Thursday. No departure from Chronopost on Friday.
These deadlines are for deliveries in Metropolitan France, for working days, excluding postal delivery problems and depending on the availability of products.
Other countries:
For the European Union and Switzerland, deliveries are generally made within 5 working days (average times noted). For other countries and the DOM-TOM, delivery times vary according to distance and carriers.
Our Sales Department can provide you with any additional information as well as an estimate of delivery times.
In case of absence at your home during the passage of the deliveryman, a notice of passage will be deposited in your mailbox. You can then collect your package in the agency indicated on the voucher with an identity document and the voucher.
Article IX – Payment
Payment for your purchases is made in cash:
Either on our site by credit card: Visa, MasterCard, American Express, other credit cards (Ecarte bleue) – by the CIC Payment solution in conjunction with our bank CIC Cabestany.

Or by PayPal.
No payment period is granted and orders are not sent until payment has been received and cashed.
The discount codes distributed by the grocery store France-Export-FV giving benefit from offers are valid within the limits of available stock. Discount codes can be used until their expiry date.
Article X – After-Sales Service
You have a period of 14 days from receipt of your products to exercise your right of withdrawal at the grocery store France-Export-FV without having to justify reasons or pay a penalty.
In case of return following an error on our part, or due to a poor quality product, we take care of the return costs.
In case of exercise of the right of withdrawal within the aforementioned period, we ask you to contact us.
We will refund the product(s) concerned within a maximum of 15 days of your request. The costs of delivery and return are the responsibility of the buyer, unless the concern comes from the product received not in accordance with expectations.
Returns must be made in their original condition and complete (packaging, accessories, instructions ...) accompanied by a copy of the purchase invoice.

We will not be able to accept returns of products that have been opened or whose packaging has been damaged. No return or replacement of products will be accepted for fresh products or for all products after expiry of the use-by date.
Right of Withdrawal
As France Pro Export Distribution only sells food products, products can only be returned if they have not been opened (this for reasons of expiry and hygiene and health protection).
As a consumer you have a right of withdrawal on your order.
In case of non-compliance with delivery times, L'épicerie France-Export-FV-Online undertakes to carry out any necessary investigation and to reimburse the shipping costs.
The grocery store France-Export-FV-Online will inform the customer as soon as possible of any delay.
Lost / unsealed packages
In case of loss of a package (La Poste or the carrier has misplaced the package during the delivery and the customer has never been delivered), the grocery store France-Export-FV-Online undertakes to ship at its expense a second package.
The grocery store France-Export-FV will then ask the recipient to provide a certificate on his honor indicating the non-receipt of the package with an undertaking to refuse the 1st shipment in the event that it ends up arriving safely. This certificate will be used to file a complaint with the carrier and possibly with the police services.
Defective or damaged products
The grocery store France-Export-FV will carry out all useful checks and will ask the customer if necessary to ask for any information, or useful photos. If the answer is favourable, we undertake to exchange the apparently defective, damaged or damaged products.

Money Back Guarantee.

We will then ask you to clearly explain to us the reason for your dissatisfaction. If we respond to your request:
We reserve the right to ask you to return the product concerned in its original packaging as soon as possible at our expense in order to be able to open a quality investigation.
We will offer you the refund of the product purchased (excluding shipping costs).
If the claim for the "money back" guarantee relates to an item ordered in multiple units, we will only be able to refund up to one open item. Other items must be returned intact in their original packaging.
This "satisfied or refunded" guarantee is limited in time to a period of two months following the order. This period is reduced to 15 days for products to be consumed upon receipt of the order.
Guarantees
The legal guarantee of conformity (Articles L. 217-4 to L. 217-14 of the Consumer Code).
The professional seller must deliver a good in accordance with the contract. Otherwise, it is responsible for defects during delivery, but also for all those resulting from the packaging, assembly instructions or installation when it is the responsibility of the contract or under its responsibility (Article L.217-4).
Conformity of the property
A good is compliant, according to Article L.217-5, when it is either

Time
The action for guarantee of conformity is prescribed by 2 years from the delivery of the good.
For goods purchased after March 18, 2016, all defects of conformity appearing during the 2 years following the purchase, with the exception of second-hand goods whose period will be maintained at 6 months, are presumed to exist. This presumption reverses the burden of proof to the benefit of the consumer; it is up to the professional to prove that the defect did not exist.
Exceptions
The consumer may not invoke the guarantee of conformity according to Article L.217-8 in three cases:
When he was aware of the defect at the time of contracting;
When he could not ignore the defect at the time of contracting;
When the defect results from materials that he himself has supplied.
Implementation of the guarantee of conformity
Where there is a lack of conformity, the trader shall propose to the consumer the replacement of the goods or their repair. The choice depends on the consumer, except where the latter entails costs for the trader which are disproportionate to the second plea.
The consumer can obtain the termination of the contract or its reduction (reduction of the price of the good) if the defect is major and the period of the chosen solution exceeds 1 month from the request; or that no means are feasible.
No costs may be charged to the consumer for the replacement, repair, termination or reduction of the contract.
The legal guarantee against hidden defects (articles 1641 to 1649 of the Civil Code).
The seller is bound by the guarantee in respect of hidden defects of the thing sold which render it unfit for the use for which it is intended, or which so diminish this use, that the buyer would not have acquired it, or would have given only a lower price, if he had known about them.
The legal guarantee covers all costs incurred by hidden defects.
The professional is not liable for apparent defects and of which the buyer has been able to convince himself, but hidden defects, even if he would not have known about them, unless, in this case, he has stipulated that he will not be obliged to any guarantee.
The defect must predate the sale and render the products unfit for the use for which they are intended.
The buyer has the choice:
Return the thing and have the price returned;
Keep the thing and get part of the price returned;
The period to act is 2 years from the discovery of the defect.
It is the trial judges who sovereignly assess whether the thing sold is unfit for its purpose.
Examples:
The impossibility in which the seller found himself to restore the machine sold to working order shows that the defect made the thing unfit for the use for which it was intended;
The attitude of the seller who, after two successive breakdowns affecting the same part, agrees to replace it at his own expense, establishes, in the absence of contrary elements, the existence of a hidden defect.
Article XI - Reimbursement
Refunds of products in the cases referred to in Article X will be made as soon as possible and at the latest within 15 days of the date on which the right was exercised. The refund will be made on the proposal of the grocery store France-Export-FV.

In the case of total or partial payment by gift vouchers, these cannot be refunded either in cash, by cheque or by credit card. The refund of purchases made by gift vouchers will be made exclusively in the form of gift vouchers.
Article XII – Liability of France-Export-FV-Online
